About this course

Learning objectives

  1. Analyze the core functions and purposes of various Alternative Dispute Resolution (ADR) methods, including negotiation, mediation, arbitration, and hybrid approaches, to differentiate them from traditional litigation.
  2. Evaluate the advantages and disadvantages of specific ADR processes such as Summary Jury Trials, Mini-Trials, Mediation-Arbitration, Private Judging, and Private Neutral Fact-Finding, to determine their suitability for different dispute types.
  3. Apply problem-solving and negotiation techniques within simulated mediation scenarios, demonstrating an understanding of a mediator’s functions and effective dispute resolution strategies.
  4. Explain the procedural steps and key characteristics of distinct ADR mechanisms like Early Neutral Evaluation and Private Neutral Fact-Finding, articulating their respective roles in dispute resolution.
  5. Discuss the “Principle of Exclusivity” and the role of unions as bargaining representatives within the broader context of dispute resolution, connecting labor relations to ADR principles.

Continuing Education Information

This is an accelerated course. You will be expected to spend an average of at least 8 hours per week reading and completing writing assignments. Please note that extensions will not be granted for this online course. This course is the equivalent of at least 45 clock hours of study. Every assignment must be completed with at least 70% in order to pass this course.
